Data protection

Privacy policy

mcs marketing communication solution GmbH appreciates your interest in its services and your visit to this website. mcs marketing communication solution GmbH respects your privacy. Please read the information on data protection thoroughly to find out how we handle your personal data. If we receive personal data from you, it will be handled with the utmost care.

Personal data

“Personal data” is detailed information relating to the personal or material circumstances of an identified or identifiable natural person. “Personal data” is any information relating to an identified or identifiable individual (hereinafter “person concerned”): An identifiable individual is one who can be identified, directly or indirectly, on the basis of an association with an identifier such as a name, an identification number, location data, an online identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that individual.

Collection and storage of data

Our website collects a range of general data and information with each visit by a person concerned or an automated system. This general data and information is stored in the server’s log files. The following can be collected

  1. browser types and versions used,
  2. the operating system used,
  3. the website from which an accessing system arrives at our website (so-called referrer),
  4. the sub-websites which are accessed via an accessing system on our website,
  5. the date and time of access to the website,
  6. an internet protocol address (IP address),
  7. the internet service provider of the accessing system and
  8. other similar data and information that serves to avert danger in the event of attacks on our information technology systems.

When using this general data and information, mcs marketing communication solution GmbH does not draw any conclusions about the person concerned. This information is mainly used in order to

  1. to deliver the contents of our website correctly,
  2. optimise the contents of our website as well as the advertising for this,
  3. ensure the long-term functionality of our information technology systems and the technology of our website, and
  4. to provide law enforcement authorities with the information necessary for prosecution in the event of a cyber attack.

This anonymously collected data and information is therefore evaluated by mcs marketing communication solution GmbH both for statistical purposes and with the aim of increasing the data protection and data security of our enterprise, in order to ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files is stored separately from any personal data provided by a person concerned.

We provide you with the opportunity to contact us with your questions via a form provided on the website. In doing so, it is necessary to provide a valid e-mail address so that we know who the enquiry is from and are able to answer it. Further information may be provided voluntarily. Data processing for the purpose of contacting us is carried out in accordance with Art. 6 (1) (a) GDPR on the basis of your freely given consent. The personal data collected by us for the use of the contact form will be automatically deleted after the handling of your request.

Furthermore, you can contact us about current job vacancies posted on our website. You must provide a valid e-mail address so that we know who is interested in the job offer and we can respond to your enquiry. Further information may be provided voluntarily. Data processing for the purpose of processing your application, contacting you and potential contract initiation with us is carried out in accordance with Art. 6 (1) (a) GDPR on the basis of your freely given consent.  The personal data collected by us for the use of the contact form will be automatically deleted after the handling of your request.

In addition, the mcs marketing communication solution GmbH website provides you with the opportunity to subscribe to our company newsletter. The personal data transmitted to the data processor when subscribing to the newsletter is specified in the input mask used for this purpose.

Processing

“Processing” refers to any process or set of processes, with or without the aid of automated procedures, which is carried out on personal data, such as collection, recording, organisation, filing, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, deletion or destruction.

To protect this data, mcs marketing communication solution GmbH takes technical and organisational measures to protect your data against unintentional modification, unauthorised access or unauthorised disclosure or loss.

mcs marketing communication solution GmbH will only process your personal data insofar as this is necessary for our product range and you have freely given us your electronic or other consent to do so.

If particular, sensitive personal data is collected, used and utilised, we will only process this data if we have received your explicit consent in advance.

We collect your data in the following cases exclusively for the purpose of:

  • Registration as an interested party
  • Sending of documents
  • Mutual submission of information and offers, whether as a private or commercial user
  • Sending contact forms and/or questionnaires
  • Subscriptions to newsletters and the sending of newsletters

For some services (e.g. sending documents by post) we need your personal data so that it can be used appropriately and processed correctly. This includes, for example: name, address, gender or title, date of birth, customer number, telephone number, fax number and e-mail address.

The filling in of the designated fields is completely voluntary and may be discontinued at any time upon request (e.g. newsletter subscription).

We would like to point out that depending on your social network settings and whether you are logged into the social networks, certain personal data (e.g. user name, interests, marital status, photos, posted comments, etc.) may be transmitted.

If you use social networks to contact us, we request that you also observe the terms of use and data protection declarations of the respective provider, as we have no influence over these.

We would like to inform you that the provision of personal data is sometimes required by law (e.g. tax regulations) or may also result from contractual regulations (e.g. information on the contractual partner). Sometimes, in order to conclude a contract, it may be necessary for a person concerned to provide us with personal data that must subsequently be processed by us. For example, the person concerned is obliged to provide us with personal data if our company concludes a contract with him or her. Failure to provide the personal data would render the contract with the person concerned impossible to conclude. Before providing personal data, the person concerned must contact our data protection officer. Our data protection officer will inform the person concerned on a case-by-case basis whether the provision of the personal data is required by law or by contract, or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data and what the consequences of not providing the personal data would be.

Consent

We process personal data in accordance with Art. 6 (1) GDPR. In addition, we are obligated in accordance with the requirements of the Telemedia Act to record your (electronic) consent to the collection or use of personal data. You can access the content of the (electronic) consent at any time upon request and revoke the consent at any time with effect for the future. Upon receipt of your revocation, we will delete your data unless we are required by law to retain it.

If we process your personal data on the basis of our legitimate interests (or on the basis of legitimate interests of third parties, such as partners and others to provide our service or products), we will tell you in advance what those legitimate interests are.

Fundamentally, we have a legitimate interest in offering you and our customers success-controlled marketing and communication solutions. mcs marketing communication solution GmbH processes personal data, inter alia, for the following purposes

  • Placement of ads on social and advertising networks
  • Maintenance and support of the brand presentation on social networks

If you have any questions regarding the legal basis for processing your personal data or require further information, please contact us using the contact details provided.

If you would like to contact us, please write to:

We only collect the data we need so that we or our partners can send you personalised information and offers. If you do not give your consent, we ask for your understanding that you will not be able to use this particular service.

Following consent by the user, mcs marketing communication solution GmbH is entitled to collect and process personal data as well as profile data and demographic data for the following purposes:

  • Inclusion in a directory of registered users/interested parties
  • Sending information about our services and offers
  • Sending of the newsletter as well as further information, also by post or other means
  • Adaptation of the offers and services of mcs marketing communication solution GmbH by means of topics tailored to the user
  • Personalisation to improve and adapt these services and advertising to the interests and preferences of the user and for market research purposes.

Since the decision-making process for services of mcs marketing communication solution GmbH can also extend over several years, all new means of contact and information provision that arise in the future are expressly permitted, even if they were not yet available at the time consent was given. In this respect, the use of new means of information and contact is not a change of purpose and therefore does not require new consent as long as the original purpose remains in place.

Here, we would once again like to highlight the possibility to revoke consent.

Data usage

mcs marketing communication solution GmbH carries out analyses of user behaviour in order to identify approaches for optimising services. These analyses are not carried out on a personal basis, but are pseudonymised, i.e. the name and other identification features are replaced by an identifier for the purpose of excluding or making it considerably more difficult to determine the person concerned.

Of course, we do not inform third parties – such as our advertising customers – who has clicked on which offer and when, unless you have expressly consented to the transfer of your data to third parties.

We would like to draw your attention to the fact that you can object to the processing of data for the purpose of advertising and market research or for needs-based design at any time.

If you would like to contact us, please write to:

Transfer to third parties

As a matter of principle, mcs marketing communication solution GmbH will not pass on the data collected and stored with your consent to third parties, in particular not to ‘address traders’ or for advertising purposes. It is only passed on to selected business partners in certain cases in order to gain additional specialist knowledge and expertise for the fulfillment of our contracts. Our legitimate interest in passing on the data is to provide our services to customers quickly and to continuously optimize them.

It goes without saying that our business partners are obliged to comply with the statutory data protection regulations to the same extent as we do.

Cloud

mcs marketing communication solution GmbH may store your data in a so-called cloud. The data is processed centrally by a cloud provider and stored in various locations. mcs marketing communication solution GmbH has taken contractual and organisational measures to protect your personal data.

Google Analytics

mcs marketing communication solution GmbH also uses Google Analytics, a web analytics service provided by Google, Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”).

Google (Universal) Analytics uses methods that allow an analysis of your use of the website, such as so-called “cookies”, text files that are stored on your computer. The information generated about your use of this website is generally transmitted to a Google server in the USA and stored there. By activating IP anonymisation on this website, the IP address is shortened before transmission within the Member States of the European Union or in other signatories to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The anonymised IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

You can prevent Google’s collection of the data generated by the cookie and related to your use of the website (incl. your IP address) as well as the processing of this data by Google by downloading and installing the browser plug-in available under the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

As an alternative to the browser add-on or on browsers on mobile devices, please click on this link to prevent the collection of data by Google Analytics on this website in the future (the opt-out only works in the browser and only for this domain). Embedded videos and images from external websites

Some of our pages contain embedded content from YouTube, Google Fonts or Google Maps. When only accessing a page from our website with embedded videos or images from our YouTube and/or Google channel, no personal data, with the exception of the IP address, is transmitted. In the case of YouTube and Google, the IP address is transmitted to Google Inc., 600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).

Data retention/deletion obligation

You may at any time review, amend or delete any personal data you have provided us with by emailing us at info@agentur-mcs.de.

We will retain your personal data for as long as is necessary for the purpose for which your personal data was processed (for example, in order to fulfil offers, products and services or to comply with applicable tax, legal or accounting requirements.)

If the purpose for which the data is stored no longer applies, or if a storage period prescribed by the European Directives and Regulators or another responsible legislator expires, the personal data will be routinely blocked, anonymised or deleted in accordance with the legal requirements. If this is not possible (because, for example, your personal data is stored in back-up archives), we will ensure that it is stored accordingly and removed from further processing until deletion is possible.

The following data protection rights are available in detail

Every person concerned has the right granted by the European Directive and Regulation to obtain confirmation from the data controller as to whether personal data concerning him or her is being processed. If a person concerned wishes to exercise this confirmation right, he or she may, at any time, contact our Data Protection Officer or another employee of the data controller.

Any person affected by the processing of personal data has the right, granted by the European Directive and Regulation, to obtain at any time information about the personal data stored about him or her and a copy of that information from the data controller, free of charge. Furthermore, the European Directive and Regulation has granted the person concerned access to the following information:

  • the purposes of processing
  • the categories of personal data processed
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in non-member countries or international organisations
  • if possible, the planned duration for which the personal data will be stored or, if this is not possible, the criteria for determining this duration
  • the existence of the right to rectify or delete personal data concerning him or her, or the restriction of processing by the data controller, or the right to object to such processing
  • the existence of a right of appeal to a supervisory authority
  • if the personal data is not collected from the person concerned: any available information on the origin of the data
  • the existence of automated decision-making, including profiling, in accordance with Art. 22 paragraphs 1 and 4 of the GDPR and – at least in these cases – meaningful information about the logic involved and the scope and intended effects of such processing for the person concerned

Furthermore, the person concerned has the right to know whether personal data has been transferred to a non-member country or to an international organisation. If this is the case, the person concerned also has the right to obtain information on the appropriate guarantees in connection with the transfer.

If a person concerned wishes to exercise this right of access, he or she may contact our data protection officer or another employee responsible for the processing of data at any time.

Any person concerned affected by the processing of personal data has the right, granted by the European Directive and Regulation, to demand that inaccurate personal data relating to him or her be rectified immediately. Furthermore, the person concerned has the right to request the completion of incomplete personal data, including by means of a supplementary declaration, taking into account the purposes of the processing.

If a person concerned wishes to exercise this right of rectification, he or she may contact our data protection officer or another employee responsible for the processing of data at any time.

Any person concerned affected by the processing of personal data has the right, granted by the European Directive and Regulation, to demand from the data controller that the personal data concerning him or her be erased without delay, provided that one of the following reasons applies and insofar as the processing is not necessary:

  • The personal data was collected or otherwise processed for such purposes for which it is no longer necessary.
  • The person concerned withdraws the consent on which the processing was based in accordance with Art. 6 (1) (a) of the GDPR or Art. 9 (2) (a) of the GDPR and there is no other legal basis for the processing.
  • The person concerned objects to the processing in accordance with Art. 21 (1) of the GDPR and there are no overriding legitimate grounds for the processing, or the person concerned objects to the processing in accordance with Art. 21 (2) of the GDPR.
  • The personal data has been unlawfully processed.
  • The erasure of the personal data is necessary for compliance with a legal obligation under Union or Member State law to which the data controller is subject.
  • The personal data was collected in relation to information society services offered in accordance with Art. 8 (1) of the GDPR.

If one of the aforementioned reasons applies, and a person concerned wishes to arrange the deletion of personal data stored by mcs marketing communication solution GmbH, he or she may contact our data protection officer or another employee responsible for the processing of data at any time. The data protection officer of  mcs marketing communication solution GmbH or another employee will arrange for the deletion request to be complied with immediately.

If the personal data has been made public by mcs marketing communication solution GmbH and our company as the responsible party is obliged to delete the personal data in accordance with Art. 17 (1) GDPR, mcs marketing communication solution GmbH will, taking into account available technology and implementation costs, implement reasonable measures, including technical measures, to inform other data controllers who have processed the published personal data of which the person concerned has demanded the deletion of all links to or copies or replications of the personal data, unless the processing is necessary. The Data Protection Officer of mcs marketing communication solution GmbH or another employee will arrange what is necessary in individual cases.

Any person concerned affected by the processing of personal data shall have the right, granted by the European Directive and the Regulation, to demand from the data controller the restriction of processing if one of the following conditions is met:

  • The accuracy of the personal data is contested by the person concerned, for a period sufficient to enable the controller to verify the accuracy of the personal data.
  • The processing is unlawful, the person concerned objects to the erasure of the personal data and requests instead the restriction of the use of the personal data.
  • The controller no longer needs the personal data for the purposes of the processing, but the person concerned needs it for the establishment, exercise or defence of legal claims.
  • the person concerned has objected to the processing in accordance with Art. 21 (1) of the GDPR and it is not yet clear whether the legitimate grounds of the data controller override those of the person concerned.

If one of the aforementioned conditions is met, and a person concerned wishes to request the restriction of personal data stored by mcs marketing communication solution GmbH, he or she may contact our data protection officer or another employee responsible for the processing of data at any time. The data protection officer of mcs marketing communication solution GmbH or another employee will arrange the restriction of the processing.

Any person concerned affected by the processing of personal data has the right, granted by the European Directive and the Regulation, to obtain the personal data concerning him or her, which has been provided by the person concerned to a data controller, in a structured, standard and machine-readable format. The person concerned also has the right to transmit such data to another data controller without hindrance from the data controller to whom the personal data was provided, provided that the processing is based on consent in accordance with Art. 6 (1) ( a) of the GDPR or Art. 9 (2) (a) of the GDPR or under a contract in accordance with Art. 6 (1) (b) of the GDPR and the processing is carried out by automated means, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller.

Furthermore, when exercising the right to data portability in accordance with Art. 20(1) of the GDPR, the person concerned has the right to have the personal data transferred directly from one data controller to another data controller, insofar as this is technically feasible and provided that this does not adversely affect the rights and freedoms of other persons.

In order to assert the right to data portability, the person concerned may at any time contact the data protection officer appointed by mcs marketing communication solution GmbH or another employee.

Any person concerned affected by the processing of personal data has the right, granted by the European Directive and Regulation, to object at any time, on grounds relating to his or her particular situation, to the processing of personal data concerning him or her carried out on the basis of Art. 6(1)(e) or (f) of the Data Protection Regulation. This also applies to profiling based on these provisions.

mcs marketing communication solution GmbH will no longer process the personal data in the event of the objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the person concerned, or for the processing, assertion, exercise or defence of legal claims.

If mcs marketing communication solution GmbH processes personal data for the purpose of direct marketing, the person concerned has the right to object at any time to the processing of personal data for such marketing. This also applies to the profiling, insofar as it is related to this type of direct marketing.

You can also exercise this right by clicking on the “unsubscribe” or “opt-out” link in the promotional emails (newsletters or similar) that we send you. To unsubscribe from other forms of advertising (postal advertising or telemarketing), please contact us using the contact details below.

If the person concerned objects to mcs marketing communication solution GmbH’s processing for direct marketing purposes, mcs marketing communication solution GmbH will no longer process the personal data for these purposes.

In addition, the person concerned has the right, on grounds relating to his or her particular situation, to object to the processing of personal data concerning him or her which is carried out by mcs marketing communication solution GmbH for scientific or historical research purposes, or for statistical purposes in accordance with Art. 89 (1) of the GDPR, unless such processing is necessary for the performance of a task carried out for reasons of public interest.

In order to exercise the right to object, the person concerned may directly contact the data protection officer of mcs marketing communication solution GmbH or another employee. The person concerned is also free to exercise his/her right to object by means of automated procedures using technical specifications in connection with the use of information society services, notwithstanding Directive 2002/58/EC.

Any person concerned affected by the processing of personal data has the right, granted by the European Directive and the Regulation, not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or otherwise significantly affects him or her, provided that the decision

  1. is not necessary for the conclusion or fulfilment of a contract between the person concerned and the data controller; or
  2. is permitted by Union or Member State law to which the controller is subject and that law contains appropriate measures to safeguard the rights and freedoms and legitimate interests of the person concerned; or
  3. with the express consent of the person concerned.

If the decision

  1. is necessary for the conclusion or performance of a contract between the person concerned and the data controller, or
  2. it is made with the explicit consent of the person concerned, mcs marketing communication solution GmbH will implement suitable measures to safeguard the rights and freedoms as well as the legitimate interests of the person concerned, which include at least the right to obtain the intervention of a person in charge, to express his or her point of view and to contest the decision.

If the person concerned wishes to exercise rights relating to automated decisions, he or she may contact our data protection officer or another employee responsible for the processing of data at any time.

Any person concerned by the processing of personal data has the right to withdraw his or her consent to the processing of personal data at any time.

If the person concerned wishes to exercise the right to withdraw consent, he or she may contact our data protection officer or another employee responsible for the processing of data at any time.

Should a revocation be received, this will not affect the lawfulness of the processing for the period prior to your revocation, nor will it affect the lawfulness of the previous or even future processing of your personal data, insofar as there is a legal basis for this other than your consent. We will take your request seriously and process it accordingly.

We would like to inform you that you are entitled by law to file a complaint with a data protection authority regarding the processing of your personal data by us. For further information, please contact your local data protection authority. As a matter of policy, we respond to all requests we receive from individuals to ensure that you are able to exercise your data protection rights in accordance with the relevant data protection laws.

Please understand that in the event of your revocation, we will no longer be able to provide certain services such as newsletters, offers, sending of info-material or participation in competitions, as it is not possible to provide these without, for example, your e-mail address.
